Terms of Service

These Terms of Service (the “Terms”) are an agreement between you and Amazing Carriers LLC (“we”, “us”) governing your use of the OnlyTrucking platform: the web application at app.onlytrucking.app, the OnlyTrucking mobile application, and this website (together, the “Service”). By creating an account or using the Service you agree to these Terms.

1. What the Service is — and what it is not

OnlyTrucking is a software platform for trucking companies and drivers: load and dispatch management, driver settlements, safety and compliance records, expense tracking, an equipment and services marketplace, job listings, and community features.

We are a software provider only. We are not a motor carrier, freight broker, or freight forwarder; we do not arrange transportation, and we are not a party to any shipping contract. We are not a bank, lender, money transmitter, or financial advisor; bank connections exist for bookkeeping only, and no feature of the Service is financial, legal, or tax advice. Compliance with FMCSA and DOT regulations remains the sole responsibility of each carrier.

2. Accounts and companies

You must be at least 18 years old and provide accurate information. You are responsible for keeping your credentials secure and for all activity under your account.

A company account is controlled by its owner. Owners and administrators manage member roles and are responsible for the actions of the users they invite, including drivers. When a company uploads or manages driver qualification records, the company represents that it has the legal right to process those records.

We verify carrier details against the public FMCSA registry, but we do not guarantee the accuracy of any user-provided information.

3. Marketplace rules

The marketplace lets users publish listings for equipment, parts, services, and related categories, and lets buyers contact sellers.

• We are not a party to any transaction. We do not own, inspect, or guarantee any listed item, do not process payments between users, do not transfer title, and make no warranty about the condition, legality, or availability of any item or the accuracy of any listing.
• Listings must be truthful and lawful. Prohibited: items you do not have the right to sell, stolen equipment, VIN tampering, counterfeit parts, weapons, illegal goods or services, and misleading or discriminatory content.
• Listings pass pre-moderation and may be rejected or removed. We may remove any listing, restrict any account, or ban repeat offenders at our discretion, including based on user reports.
• Deal directly and carefully: verify equipment, documents, and payment before completing any transaction. Any dispute over a purchase is between buyer and seller.

4. Your content

You keep ownership of the content you post — listings, photos, reviews, forum posts, job postings, and applications. You grant us a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display that content solely to operate and promote the Service.

You are responsible for your content. Reviews must reflect genuine experience. Content that is unlawful, defamatory, harassing, or infringes someone’s rights may be removed, and repeated violations may lead to account termination. Moderation decisions may be appealed via [email protected].

5. Acceptable use

You agree not to: probe or breach security measures; scrape or bulk-export data of other users; reverse engineer the Service; use it to send spam; upload malware; interfere with its operation; or use it in violation of any law. API access is limited to documented endpoints and your own company’s data.

6. Fees

Core features are currently provided free of charge. Paid marketplace plans or subscriptions, if introduced, will be announced with their own pricing terms before you are charged anything.

7. Disclaimer of warranties

The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that data — including mileage calculations, settlement math, or compliance alerts — is accurate or complete. You are responsible for verifying regulatory and financial outputs before relying on them.

8. Limitation of liability

To the maximum extent permitted by law, Amazing Carriers LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, cargo, revenue, or data, arising from your use of the Service — including any transaction with another user. Our total liability for all claims in any 12-month period will not exceed the greater of the amount you paid us in that period or one hundred U.S. dollars ($100). Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.

9. Indemnification

You will defend and hold us harmless from claims arising out of your content, your use of the Service, your violation of these Terms, or your violation of any law or third-party right — including claims arising from transactions you enter with other users.

10. Termination

You may stop using the Service and delete your account at any time (see Account & Data Deletion). We may suspend or terminate access for violation of these Terms, unlawful activity, or risk to other users, with notice where practicable. Sections 4 and 7–12 survive termination.

11. Governing law and disputes

These Terms are governed by the laws of the State of United States, without regard to conflict-of-law rules. Before filing any claim, you agree to contact us at [email protected] and give us 30 days to resolve the issue informally. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in that state.

12. Changes to these Terms

We may update these Terms. For material changes we will give notice in the app or by email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
